Definitions and interpretation
“EANS” means Eleven Arches Night Show Ltd.
“Event” means an entertainment event including, without limitation, a concert, exhibition, sports, theatrical and/or music event to be held at a Venue in respect of which EANS have the right to sell You Tickets.
“Tickets” means tickets or other types of evidence (including electronic tickets) for an Event sold by EANS to You for the right to occupy space at or to attend an Event.
“Venue” means any facilities or locations of any nature where the Event is being held.
“We” means Eleven Arches and/or EANS. “Us” and “Our” shall be read accordingly.
“You” means you or anybody who in Our reasonable opinion is acting with your authority or permission. “Your” shall be read accordingly.
“Group” means group organisers, charities, travel and coach companies or other organisations that EANS have agreed to sell to knowing that the Tickets are intended for resale.
The website at www.elevenarches.org (our website) is owned and operated by Us.
These pages and any documents referred to on them tell you the terms and conditions on which EANS supplies tickets to you. Please read these terms carefully before ordering any Tickets from EANS, by doing so, you accept these terms and conditions.
The following sets out the terms that apply to all tickets purchased from EANS whether in person, by telephone or online. These terms and conditions apply to tickets for all performances.
All Tickets are sold by EANS subject to availability and to these Terms and Conditions. These Terms and Conditions should be read carefully prior to purchase and any queries relating to them should be raised with EANS prior to purchase, as purchase of Tickets constitutes acceptance of these Terms and Conditions. A valid Ticket must be produced to get into an Event. Removing any part of, altering or defacing the Ticket may invalidate Your Ticket.
It is your responsibility to check your tickets as if you have made a mistake it cannot always be rectified after purchase. Please check your Tickets on receipt carefully and contact us immediately if there is a mistake.
EANS will not be responsible for any Ticket that is lost, stolen or destroyed. Duplicates will only be issued at our discretion.
EANS reserves the right to provide alternative seats at an Event to those specified on the Ticket, if the staging of the Event reasonably requires it, provided that they are of no less value to that stated on the Ticket.
Where a concession is claimed, proof of identity and concession entitlement (for example of age) may be required.
Ownership or possession of a Ticket does not confer any rights (by implication or otherwise) on you to use, alter, copy or otherwise deal with any of the symbols, trade marks, logos and/or intellectual property appearing on the Ticket.
Tickets shall not be purchased from or through any person, commercial agent, company or otherwise than directly from EANS or its authorised agent.
All ticket early-bird discounts are subject to limited availability and at the discretion of the Box Office. Discounted tickets cannot be booked in conjunction with or combined with any other reductions or offers.
Price and Payment
The price of the Ticket will be as quoted on our website and shall be the price set at the time EANS accepts your order. All prices set are inclusive of applicable taxes but exclusive of any booking fee and collection or delivery fee.
If you are under 18 years old you may purchase Tickets only with the involvement of your parent or guardian.
Payment for all Tickets must be by credit or debit card. We accept all major credit and debit cards, with the exception of Amex and Diners Club International. We will not charge your credit or debit card until we confirm your order.
No order will be accepted until we have received full payment.
How the contract is formed between you and us
After placing an order, you will receive an email from us acknowledging that we have received your order and confirming whether or not we can accept that order. The contract between EANS and You (Contract) will be formed when we send you an acknowledgement email which confirms EANS’s acceptance of your offer to purchase the Tickets.
The Contract will relate only to those Tickets indicated in the acknowledgement email.
Terms applying to ticket purchases from the Eleven Arches website
Prior to placing an order online you will be required to register. This will provide you with a unique account which will be password accessed. You will thereafter be able to revisit your order.
After placing an order online you will need to click the box marked ‘Accept’ in the course of your purchase of Tickets to confirm your acceptance of these terms. If you don’t accept these terms, you will not be able to order any Tickets from our website.
Tickets will normally be delivered by email for printing by you. These will be required to be presented on the night.
EANS will not accept any responsibility for tickets that are mislaid or lost. The website will provide the facility for tickets to be reprinted. Only the first ticket presented with its unique barcode will enable access. Any and all duplicates will be void.
EANS reserves the right in exceptional circumstances to make tickets available for collection at the EANS’s box office. You will be notified by telephone, email or in writing of the arrangements for collection (using the details provided at the time of ordering). You will be told at the point of sale the arrangements for collection of your tickets. Where you are collecting your tickets from us, in person, there will be no charge made for this service. You must have your acknowledgement of order and the credit/debit card used to make the order with you.
Links and disclaimer
We may provide links on our website to the websites of other companies, whether affiliated with us or not. EANS cannot accept any liability for tickets you purchase from companies to whose website we have provided a link on our website. This disclaimer does not affect your statutory rights against the third party seller. We will notify you when a third party is involved in a transaction, and we may disclose your customer information related to that transaction to the third party seller in order for the transaction to proceed.
Changes to Event
EANS reserves the right to make alterations to the advertised details for the performance at short notice where reasonably necessary. In these instances EANS is not obliged to refund the ticket or exchange for another performance.
Kynren merchandise is available on show nights only in various locations across the site. We accept card payments only for merchandise items (with the exception of flags which are £1 for two), to create a user friendly, fast and efficient transaction process.
We reserve the right, without limitation, to permanently remove or alter content related to the merchandise terms.
Merchandise Refunds and Returns
You have a right to a remedy if goods purchased are damaged or broken. The type of remedy, and who must provide it, will depend on the problem. You can reject faulty goods and request a replacement. We do not offer any refunds. If you require a replacement item, please call 01388 311 813.
All tickets are non-refundable, and non-re-saleable.
Your ticket can only be exchanged or refunded in the event that the performance is cancelled or rescheduled.
Performances will only be cancelled due to extreme weather conditions or due to force majeure (see below). Shows will continue in the event of rain.
In the event of a cancelled performance or a performance that has to be abandoned part way through, EANS will not be liable to make any refund or pay any compensation beyond what is due on the ticket value ie EANS shall not be liable for any additional travel or accommodation expenses.
Where an Event is cancelled or rescheduled by EANS , or where an Event is cancelled or rescheduled due to circumstances beyond EANS’s control, or where there is a material change to the programme of the Event, You will be entitled to claim a refund from EANS in accordance with this clause.
A ‘material’ change is a change which, in EANS’s reasonable opinion, makes the Event materially different to the Event that purchasers of the Ticket, taken generally, could reasonably expect.
Where such a refund is sought You must bring this to EANS’s attention as soon as possible upon becoming aware of such change, cancellation or where the Event has been rescheduled, prior to the rescheduled Event. The refund for Tickets equals at least the face value price paid or, if the face value has been reduced by EANS, the discounted face value price paid in accordance with the STAR Code of Practice.
In order to claim Your refund, please apply in writing to Your point of purchase, enclosing Your complete unused Tickets, if received, promptly (e.g. within 3 months from the date of the Event). Refunds shall only be made to the person who purchased the Tickets and, when possible, be made using the same method as was used to purchase the Tickets except, at EANS’s discretion, where payment was made by cash.
These Terms and Conditions do not and shall not affect your statutory rights as a consumer. For further information about your statutory rights contact Citizens Advice (www.citizensadvice.org.uk) or the Department for Business Innovation and Skills.
EAN’s liability to you (whether in contract, tort (including negligence) or otherwise) is limited to the purchase price of the Tickets you have purchased.
EANS will not accept liability for any indirect, special or consequential losses, including (for example) loss of profits, revenue, contracts, data or goodwill.
Personal arrangements including travel, accommodation or hospitality relating to the Event which have been arranged by you are at your own risk. Liability for the cancellation or rescheduling of an Event, or for material changes to an Event, will be limited to the refund as set forth above.
EANS will not be responsible for any loss, theft or damage of Your personal belongings, other than caused as a result of EANS’s negligence or other breach of statutory duty.
Nothing in these terms limits EANS’s liability for death or personal injury caused by EANS’s negligence or for any other matter for which it would be illegal for EANS to limit, or attempt to limit, EANS’s liability.
It is Your responsibility to ascertain whether an Event has been cancelled or re-scheduled and the date and time of any re-scheduled Event. Where an Event is cancelled or re-scheduled, EANS will use its reasonable endeavours to notify You using the details You provided Us with at the time of ordering. EANS do not guarantee that You will be informed of such cancellation before the date of the Event.
It is Your responsibility to inform Us of any change to the contact address, telephone number or email address You provide Us with at the time of ordering.
Use of Details and Data Protection
Any personal information you give to us will be processed in accordance with the UK Data Protection Act 1998. We will use the information to process your request and to provide any relevant further information you may require regarding your attendance. It will also be used to support our marketing and market research activities.
Any Ticket obtained in breach of these Terms and Conditions shall be void and all, rights conferred or evidenced by such Ticket shall be void.
Reselling your ticket for profit or commercial gain makes it void.
Any person seeking to use a void Ticket in order to gain or provide entry to an Event may be considered to be a trespasser and may be liable to be ejected and liable to legal action. Void Tickets are non-refundable.
Restrictions on the purchase of tickets
EANS restricts the sale of tickets to individuals to a maximum of 10. This will be notified to You at the time You book the Tickets.
Conditions of Admission
You need a valid ticket which must be produced on arrival in order to enter the Tribune (arena).
EANS reserve the right to refuse Ticket holders admission to the Venue in reasonable circumstances including for health and safety, licensing reasons or where a Ticket is void.
EANS reserves the right to request that Ticket holders leave the Venue at any point on reasonable grounds and may take any appropriate action to enforce this right. By way of example, we may remove a Ticket holder who:
- has behaved in the Venue in a manner which, in the reasonable opinion of the Our staff or volunteers has, or is likely to affect the enjoyment of other visitors; or
- uses threatening, abusive or insulting words or behaviour or in any way provokes or behaves in a manner which may provoke a breach of the peace; or
- in the reasonable opinion of Our staff or volunteers is acting under the influence of alcohol or drugs; or
- fails, when required, to produce proof of identity or age.
To ensure our audience safety and security, EANS will search all bags and reserves the right to search vehicles or persons as a condition of entry to the show site and Tribune.
You must comply with instructions and directions given by Venue staff and Volunteers.
No refunds will be given to Ticket holders who are refused entry or ejected due to their own behaviour as suggested in, but not limited to, the examples above.
Restrictions and prohibitions
The use of equipment for recording or transmitting (by digital or other means) any audio, visual or audio-visual material or any information or data inside Our site is strictly forbidden. Unauthorised recordings, tapes, films or similar items may be confiscated and destroyed. Any recording made of an Event in breach of these conditions shall belong to Us. We will not be liable for any loss, theft or damage to confiscated items.
By attending an Event, Ticket holders consent to filming and sound recording of themselves as members of the audience. We may use such films and recordings (including any copies) without payment.
You may not combine a ticket with any hospitality, travel or accommodation service and/or any other merchandise, product of service to create a package unless formal written permission is given by EANS.
A ticket shall not be used for advertising, promotions, contests or sweepstakes, unless formal written permission is given by EANS, provided that even if such consent is obtained, use of our trade marks and other intellectual property is subject to our prior consent.
Ticket holders shall not bring into the Venue or display or distribute (whether for free or not) at the Event any sponsorship, promotional or marketing material’s.
Mobile phones, pagers and digital watches must be turned to silent at all times in the Tribune to preserve the experience for fellow audience members.
Alcohol may only be consumed in authorised areas. Smoking is not permitted unless within a designated smoking Area.
The following are not permitted on Our site:
- animals (with the exception of guide dogs);
- laser pens
- any item which may be interpreted as a potential weapon including sharp or pointed objects (e.g. knives)
- illegal substances
- Picnic furniture (tables and chairs)
- Back packs, suitcases, shopping bags or other large bags
The following will not be permitted within the Tribune seating area:-
- all of the above
- Food of any kind
- Bottles, cans, or glass containers
- Umbrellas are not permitted during the performance
Our management reserves the right to conduct security searches from time to time and confiscate any item which, in our reasonable opinion, may cause danger or disruption to other members of the audience or the Event or is one of the items not permitted in the Venue as listed above.
If you arrive later than the advertised start time or you need to leave the Tribune for any reason then you may be asked to wait until a suitable break in the performance before you can take your seat.
Ticket holders may only leave and re-enter the Tribune Seating area during an Event at the discretion of Our staff or volunteers on duty. Otherwise, there will be no re-admission or pass-outs of any kind.
The obstruction of gangways, access-ways, exits, entrances or staircases, congregating in non-designated areas or seeking entry to stands or seats for which You do not hold a Ticket is strictly forbidden.
Health and Safety
Ticket holders must comply with all relevant statutes, safety announcements and Our Venue regulations whilst attending the Event.
If Ticket holders have any special requirements or concerns about any special effects which may be featured at the Event, prior notice should be provided when ordering Tickets. Special effects may include, without limitation, sound, audio visual, pyrotechnic effects or lighting effects.
For Health & Safety reasons, wheelchair users are not permitted to transfer into fixed seating.
If any dispute arises out of these Terms and Conditions, We will attempt to settle it. To this end We shall use Our reasonable endeavours to consult or negotiate in good faith, and attempt to reach a just and equitable settlement satisfactory to both parties.
Although this does not restrict your rights to pursue court proceedings, if we are unable to settle any dispute by negotiation within 21 days, the parties may attempt to settle it by mediation. To, initiate a mediation a party must give written notice to the other parties to the dispute requesting a mediation. The mediation shall be conducted in accordance with the STAR Code of Practice and Dispute Resolution Procedure current at the date of the referral which sets out, the procedures to be adopted, the process of selection of the mediator and the costs involved, and which terms are deemed incorporated into this agreement.

If We delay or fail to enforce any of these Terms and Conditions It shall not mean that We have waived our right to do so.
We shall be entitled to assign any of Our rights and obligations under these Terms and Conditions provided that Your rights are not adversely affected.
If it is found by a Court that any of these Terms and Conditions for any reason cannot be enforced, this shall not prevent the other provisions from continuing to apply.
Any person, other than Us, not a party to these Terms and Conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions. The Act can give rights under some contracts to third parties who are not parties to those contracts but in this case only We, the Venue, and You (or your assignees permitted hereby) have rights and obligations under this contract.
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by events outside our reasonable control (Force Majeure Event).
For the purposes of these Terms and Conditions, “Force Majeure” means any act, event, omission or accident beyond our reasonable control and includes (as well as others) such things as act of God, war, insurrection, riot, civil disturbances, terrorist attack, explosion, fire, flood, or natural disaster, theft of essential equipment, malicious damage, strike, lock out, extreme/dangerous weather, third party injunction, national defence requirements, acts or regulations of national or local governments; epidemics, impossibility of the use of means of public or private transport, or public or private telecommunications networks or the threat of any of these things.
If a Force Majeure Event occurs, we may have to cancel a performance or abandon it part way through and our obligations to you are deemed to be suspended for the period that the Force Majeure Event continues. We will use our reasonable endeavours to find a solution by which our obligations may be performed despite the Force Majeure Event.
Amendments and variations
We intend to rely on the written terms set out here in this document. You should read the terms and conditions carefully before entering into the contract to ensure that they contain everything that You consider has been agreed. If they do not then you should speak to any member of staff.
We may revise these terms and conditions at any time by amending this page. You should check this page from time to time to take notice of any changes we have made, as they may be binding on you.
However, any Contract will be subject to the terms in force at the time that you order Tickets from EANS, unless any change to these terms is required to be made by law or governmental authority (in which case it may apply to orders previously placed by you).
No Partnership or Agency
Nothing in these Terms and Conditions and no action taken by You or Us under these Terms and Conditions shall create, or be deemed to create, a partnership, joint venture or establish a relationship of principal and agent or any other relationship between You and Us beyond the relationship created under these Terms and Conditions.
We may transfer, assign, charge, sub-contract or otherwise dispose of any Contract at any time, but you may not do so without our prior written consent.
If we fail to exercise any of our rights under any Contract, this will not amount to a waiver by us of those rights.
If any part of these terms or of any Contract is unenforceable, this will not affect the enforceability of any other part.
These Terms and Conditions and any specially agreed terms constitute the entire agreement between the parties in connection to, its subject matter and supersede any previous terms and conditions, agreement or arrangement between the parties.
Each of the parties agrees that it has not entered into these Terms and Conditions in reliance on, and shall have no remedy in respect of, any statement, representation, covenant, warranty, undertaking or indemnity (whether negligently or innocently made) by any person (whether party to these Terms of Conditions or not) other than as expressly set out in these Terms and Conditions. Nothing in this clause shall operate to limit or exclude any liability for fraud.
Applicable laws require that some of the information or communications we send to you should be in writing. When using our website, you accept that communication with us will be mainly electronic. We will contact you by email or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This section does not affect your statutory rights.
All notices given by you to us must be given to Eleven Arches, Flatts Farm, Toronto, Bishop Auckland, County Durham DL14 7SF or by email [email protected] We may give notice to you at either the email or postal address you provide to us when placing an order with EANS, or in any of the ways specified in section 7 above. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an email is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an email that such email was sent to the specified email address of the addressee.
Governing Law and Jurisdiction
These terms and Conditions will be governed by English law. Any dispute over or claims arising from these terms or any Contracts will be subject to the exclusive jurisdiction of the English courts, although we retain the right to bring proceedings against you for breaking these terms or any Contract in your country of residence or any other relevant country.

EANS is a company limited by shares and registered in England and Wales.
